Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Nexrypt Loc8, a mobile security and anti-theft application that is a product of Nexrypt Technologies, a company registered in Kenya ("we", "us" or "our").

By creating an account, installing the application or using any part of our service, you confirm that:

• You have read and understood these Terms.
• You are at least 18 years old or have the consent of a parent or legal guardian.
• You have the legal capacity to enter into a binding agreement.

2. User Accounts and Obligations

To use Nexrypt Loc8, you must create an account. When you do, you agree to:

• Provide accurate, complete and current information when registering.
• Keep your password secure and not share it with anyone.
• Notify us immediately at info.nexryptloc8@gmail.com if you suspect your account has been accessed without your permission.
• Take full responsibility for all activity that occurs under your account.

Age Requirement: You must be at least 18 years old to use Nexrypt Loc8. Users under 18 may only use the service with documented parental or guardian consent.

3. Acceptable Use Policy

Nexrypt Loc8 is built for device security and anti-theft purposes only. Using it for anything outside of this is a violation of these Terms. You agree that you will not:

• Install the app on a device that you do not own or do not have explicit, written permission to monitor.
• Use the app to spy on, stalk, harass or surveil any person without their knowledge and consent.
• Use the app to gather evidence for purposes that are illegal under Kenyan or international law.
• Attempt to hack, reverse-engineer or tamper with the Nexrypt Loc8 application or our servers.
• Use the service to transmit malware, spam or any harmful content.
• Misrepresent yourself or impersonate another person when using the service.

4. Intellectual Property

All content included in Nexrypt Loc8 — including but not limited to the application code, design, logos, interface elements, text and graphics — is the intellectual property of Nexrypt Technologies and is protected under applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Nexrypt Loc8 application for its intended personal security purposes. You may not:

• Copy, modify or distribute any part of the application or website content.
• Use our name, logo or branding without our prior written permission.
• Create derivative products based on our application or service.

5. Subscriptions and Payments

Nexrypt Loc8 offers both free and paid plans. The following applies to paid subscriptions:

• Pricing: Current subscription prices are shown on the upgrade page and may change with prior notice.
• Billing: Subscriptions are billed based on the plan you select.Billing begins on the date of purchase.
• Renewals: If you are on a recurring plan, your subscription will renew automatically unless you cancel it before the renewal date.
• Refunds: Due to the nature of digital services, refunds are not guaranteed. However, if you believe there has been an error in your billing, please contact us within 7 days of the charge at info.nexryptloc8@gmail.com and we will review your case.
• Cancellation: You can cancel your subscription at any time. You will continue to have access to premium features until the end of your current billing period.

6. Limitation of Liability and Warranty Disclaimer

Nexrypt Loc8 is provided "as is" and "as available". While we work hard to keep the service running reliably, Nexrypt Technologies makes no guarantees and is not liable for:

• Failure to track a device that is offline, powered off or has its battery depleted.
• Loss of data caused by device hardware failure or third-party software interference.
• Inability to recover a stolen device despite using the service.
• Service downtime caused by server maintenance, third-party outages or unforeseen technical failures.
• Any indirect, incidental or consequential damages arising from your use of, or inability to use, the service.

Our liability to you in any situation is limited to the total amount you have paid us in the 3 months preceding the event that caused the issue.

7. Termination

We reserve the right to suspend or permanently close your account if:

• You violate any part of these Terms.
• We suspect your account is being used for illegal or unauthorized purposes.
• You provide false information during registration.
• Your account has been inactive for more than 12 consecutive months (we will send an email warning before this happens).

8. Governing Law and Dispute Resolution

These Terms are governed by and interpreted under the laws of Kenya. Any dispute arising from your use of Nexrypt Loc8 that cannot be resolved through direct communication with us will be submitted to the jurisdiction of the courts of Kenya.

Before initiating any legal proceeding, you agree to first contact us at info.nexrypt@gmail.com and give us 30 days to resolve the issue in good faith.

9. Changes to the Service

Nexrypt Technologies reserves the right to:

• Update, modify or add features to Nexrypt Loc8 at any time.
• Discontinue specific features with reasonable notice to users.
• Change subscription prices, with a minimum of 14 days' notice before the change takes effect.

We will notify you of significant changes via email or a notification on your dashboard. Continued use of the service after any change means you accept the updated terms.
